1. Role of Merker Travel Design
Merker Travel Design LLC (“I,” “we,” “our,” “us”) acts solely as an independent travel advisor.
We do not own, operate, manage, or control any suppliers of travel services, including but
not limited to airlines, cruise lines, tour operators, hotels, resorts, tr ansfer companies, or
insurance providers.
2. Supplier Responsibility
All bookings are made subject to the terms and conditions of the supplier. The supplier is
solely responsible for delivering the travel services purchased. We are not responsible for
the acts, errors, omissions, representations, warranties, breaches, or negligence of any
supplier or for any personal injuries, death, property damage, or other damages or
expenses resulting therefrom.
3. Documentation & Entry Requirements
It is the traveler’s responsibility to ensure that all required travel documents are valid and
up-to-date, including passports, visas, health certificates, and any other documentation
required by the destination or transit countries. We may provide general information, but
requirements can change at any time and vary by destination.
4. Travel Insurance
We strongly recommend that travelers purchase comprehensive travel insurance to
help protect against trip cancellation or interruption, medical expenses, evacuation, lost
luggage, and other potential losses. Insurance coverage is subject to the terms, conditions,
and exclusions of the policy.
5. Limitation of Liability
To the fullest extent permitted by law, Merker Travel Design LLC shall not be liable for any
indirect, incidental, special, consequential, or punitive damages. Our aggregate liability, if
any, shall not exceed the amount of fees paid directly to us for our advisory services
related to the claim.
6. Force Majeure
We are not liable for failure or delay in performance caused by acts of God, natural
disasters, pandemics, government actions, labor disputes, or other events beyond our
reasonable control.
7. Governing Law
This Disclaimer shall be governed by and construed under the laws of the State of Ohio.
8. Acknowledgment
You confirm that you have read, understood, and agree to these terms and conditions.
Supplier Ticket Contracts & Terms
All bookings are subject to the terms, conditions, and liability limitations of the respective travel supplier (e.g., cruise line, hotel, tour operator). These govern in case of conflict and may be provided at the time of booking.
Regulatory & Membership Disclosures
Seller of Travel: Where required by law, bookings are sold through our host agency and/or the applicable Seller of Travel registrations.
Affiliations: Merker Travel Design LLC operates as an independent affiliate of a host agency (e.g., Nexion Travel Group) and network (e.g., Travel Leaders Network). We anticipate participation in and/or certification by leading industry organizations (e.g., ASTA, CLIA, etc.).
Compensation Disclosure
We may receive commission from travel suppliers for reservations you choose to book. We may also charge transparent planning/advisory fees for our professional services. Any supplier commission does not increase the price you pay versus booking directly; our fees (if applicable) will be disclosed in advance.
